NOTICE OF ADOPTION AND POSTING OF ZONING TEXT AMENDMENT AND MAP AMENDMENT ORDINANCE

PLEASE TAKE NOTICE that a Park Township Zoning Text and Map Amendment Ordinance was adopted at a meeting of the Park Township Board held on August 13, 2020, amending the Park Township Zoning Ordinance. The amendment is to take effect on September 25, 2020, provided that this effective date shall be extended as necessary to comply with the requirements of Section 402 of the Michigan Zoning Enabling Act. A summary of the regulatory effect of the amendment is as follows.

The text amendment proposes to add Division 6B – OB Ottawa Beach Overlay District which will establish a Description and Purpose section to outline the goals and objectives of the Division; will establish a Use Regulations section to maintain underlying district regulations, to provide for the application of the provisions of the overlay district unless otherwise silent, to prohibit new commercial uses, to establish side yard averaging for improved lots, to establish a maximum principal building height for improved lots, to establish minimum parking for improved lots, to allow for the reconstruction of a pre-existing principal building, to provide for minimum lot area and lot width for construction on unimproved lots, to establish side yard averaging for unimproved lots, to establish a maximum principal building height for unimproved lots, to establish minimum parking for improved lots and, to establish the extent of a building footprint; will establish a Recreational Fires section to provide for setbacks of recreational fires and portable outdoor fireplaces, minimum fire ring specifications, maximum fire diameter, types of materials that may be burned, a reliable water supply, wind speed limitations, extinguishment of fires, attendance at fires, prohibitions on unimproved lots and, Fire Department oversight and; will establish a Lots within the District section, which identifies the parcel numbers of the properties within the proposed overlay district.

Further, the text amendment will amend Section 38-6 – Definitions to create a definition of Fire Grate and a definition of Recreational Fire; will amend Section 38-155 – Zone Districts to add the OB Ottawa Beach Overlay District to the districts within the Zoning Ordinance; will amend Section 38-506(1) – Home Occupations to include the prohibition of retail sales for home occupations within the proposed Ottawa Beach Overlay District and; will amend Section 38-601 – General Parking Requirements to allow for required off-street parking to be located within a garage or one other accessory building within the proposed Ottawa Beach Overlay District.

The map amendment proposes to add the Ottawa Beach Overlay District for that portion of land located in Park Township that is generally described as follows: An area more or less located north of the channel to Lake Macatawa, extending from the shore of Lake Michigan to the shore of Lake Macatawa, west of 168th Avenue and south of South Lakeshore Drive, excluding the approximately east two thirds of the north side of North Road and excluding the areas generally served by Spyglass Hill, Seawatch Road, and Dune View Court.
