BOARD MEETING MINUTES

Art 1

The regular meeting of the Park Township Board held on January 9, 2003, at 6 p.m. was called to order by Supervisor Stuart Visser.

Present were Supervisor Stuart Visser, Clerk Howard VanRaalte,   Trustees Ed Marsilje, Amanda Price, Gene Koopman, and Paul VanDyke, and Attorney Tom Boven.

Absent was Treasurer Jan Steggerda

Art 2 The minutes of December 12, 2002 were approved as printed.
Art 3

The Treasurer's Report was given as follows:

Beginning Balance                     $2,381,001
Receipts                                   $     35,955 
Disbursement                            $   297,956

Ending Balance             $2,119,000

Art 4 The Fire Department report indicated 12 calls were made in the month of December with $11,700 in property damage
Art 5

The Zoning Administrator's Report indicated building permits were issued for 13 single-family homes in December and a total of  $4,268,400.  A recap of the year 2002 shows building permits were issued for 117 single-family homes and a total of $44,701,000.                                  

Art 6

Koopman reported that 6 Liquor Inspection reports had been turned in from December.  All establishments were in compliance and good condition.

PUBLIC COMMENT

No public comment.

 

Art 8

LAND ACQUISITION

Visser asked for a motion to go into closed session to discuss property matters.

MOTION MADE, MOTION SUPPORTED, MOTION CARRIED:  A motion was made by VanRaalte and supported by Marsilje to go into closed session to discuss property matters.

Visser explained any decision to be made would be done in open session.  There will only be discussion during a closed session.

Board adjourned to closed session.

Board returned to open session.

Visser explained the Board was briefed by our attorney on a disposition of road ends and reserves in Waukazoo Woods.  We have taken no action but there is a proposed action. 

Marsilje read the Resolution.

MOTION MADE, MOTION SUPPORTED, MOTION CARRIED:  A motion was made by Marsilje and supported by Koopman to adopt the resolution.

Visser stated Post Avenue will remain a public street to the waters edge; Maple Walk has no public claim and will be permitted to be sold by the heirs of Judge Everett; Pine Walk would retain a 30 feet wide road end right-of-way to Lake Macatawa with 10 feet on each side for private property; Hemlock would remain a private reserve under claim of ownership by the heirs of Judge Everett; Fallen Leaf (Ashwood) would be deeded to Park Township, Dyken will remain a public right-of-way street end; Post Avenue and 160th Street would remain public right-of-ways.

VanRaalte questioned if Park Township acquires more land will we be picking up more liability. 

Boven replied Park Township would have the same liability as other properties we already own.

PAYMENT OF BILLS

MOTION MADE, MOTION SUPPORTED, MOTION CARRIED:  A motion was made by Marsilje and supported by Koopman to approve the check register for December and bills to be paid for January.

Art 11

ADDITIONAL COMMENTS FROM AUDIENCE & BOARD

Audience:

Fred Porter, 625 Harrington Avenue, questioned what action brought Park Township to consider the Land Acquisition. 

Visser explained the history leading back to the early 1900’s.

Boven explained a case in 2000 that made the heirs of Judge Everett determine their land.

Board: 

Visser suggested if someone from the ZBA is going to be absent two consecutive meetings that the Board appoints an alternant.  State law permits this if it is authorized by our ordinance.  He feels it would be an excellent idea to amend our ordinance to allow this.
